| Court registers complaint against SHO RS Pura | | | Jammu, Aug 7 First Additional Sessions Judge G K Pandita has taken cognizance of a complaint against Station House Officer RS Pura for allegedly committing offence of causing simple injury, wrongful confinement and criminal intimidation under section 504/506/341/323/342/382 RPC and directed the accused to be present before the court on the next date of hearing.
The order was passed by the court in a complaint filed by Jaspal Singh son of Sardar Singh of Simble Ward No 2, Miran Sahib Jammu against SHO RS Pura Inspector Kuldeep Khajuria.
The complaint filed under sections 295-A/298/341/323/342/382/504/506 R.P.C was presented by the complainant before Chief Judicial Magistrate Jammu on August 3 but it was returned to the complainant on the same date, as the complaint involved the offences u/s 295-A and 298 of the RPC, for presentation before proper forum. It was later on presented before the Principal Sessions Judge, Jammu who transferred it to this court of First Additional Sessions Judge.
As per the complainant on August 2 at about 1 PM when the complaint was going to Tehsil Office, R.S. Pura, the SHO without any right or reason caught hold of him, slapped him; made his turban to fall down on the ground; obstructed his way, dragged him by catching his hair, lodged him in police lock up and took Rs. 10,000 from his pocket.
He further alleged that the SHO used filthy language used the word Sikh against the complainant, with the intention of wounding of his religious feeling. The complainant further alleged that the accused threatened the complainant of dire consequences.
After recording the preliminary statement of the complainant and his one witness the court observed that at this stage case under sections 504/506/298/341/323/342/382 RPC is made out against the accused, as the alleged acts of the accused have no relation with his official duties.
The court further directs entering of the complaint in the concerned register. The concerned section of the court was directed to summon the accused on the next date of hearing. |
