| DB disposes PIL regarding encroachment of Forest Land in Udhampur | | | Early Times Report
Jammu, Aug 30 : In a Public Interest Litigation (PIL) filed by one Romesh Kapoor regarding encroachment of forest land in Udhampur District, a Division Bench (DB) of State High Court comprising Justice Virender Singh and Justice Tashi Rabstan disposed of PIL as grievances projected in the instant Public Interest Litigation stand redressed. After hearing Adv Ajay Abrol for the PIL whereas AAG HA Siddiqui appearing for the State, the Division Bench observed that since the demarcation has been carried out in the presence of Officials/Officers of Forest Department who are also signatory to the report, perhaps there appears to be no reason for G S Thakur representing Forest Department to join issue on this aspect. He has, however, not come present to assist the Court.Division Bench further observed that Deputy Commissioner Udhampur, who is present in the Court, assures the Court that she will take up the matter with regard to demarcated area of Forest land which turns out to be 104 kanal and 4 marlas with Social Forestry Department as well as the Forest Department so that this particular area is developed. At this Stage, Adv Ajay Abrol appearing for the PIL stated that the grievances projected in the instant Public Interest Litigation stand redressed and Division Bench disposed of the PIL. Here it needs to mention as per Earlier Order, Deputy Commissioner Udhampur Ms Yasha Mudgal has present alongwith the complete status report. As per the compliance report a team of Officers/Officials of Revenue and Forest Department constituted by Tehsildar Chenani visited the village Sarar Karpalt of Tehsil Chenani on 17/07/2014 for conducting a joint demarcation of khasra No.719 measuring 276 kanal 04 marla, The demarcation was conducted by this team in presence of concerned villagers, Lamberdar and chowkidar of the village. The demarcation process has been completed and the demarcation report is mentioned that the khasra No.719 comprises of Shamlat deh land, Kahcharai land and forest land as per the spot and as per the relevant Revenue record. After that the shamlat deh land falling under khasra No.719 was measured on spot which came out to be 95 kanal 15 marla and was found intact as per spot and as per relevant Revenue record also. After that Kahcharai land falling under khasra No.719 was measured on spot which came out to be 76 kanal 04 marla and was found intact as per spot and as per relevant Revenue record also. After the Forest land falling under Khasra No. 719 was measured on spot which came out to be 104 kanal 05 marls and was found intact and in possession of Forest Department as per spot and as per relevant Revenue record also. During this demarcation process, on spot no encroachment on forest as well as kahcharai land was found. The team from Forest department is satisfied with the demarcation and also the concerned villagers are also satisfied. A reply has been furnished to Deputy Commissioner Udhampur vide this office letter No. 635/OQ Dated:-24/07/2014 which reads: "No encroachment or any construction has been found on the Forest land as well as on the Kahcharai land falling under Khasra No.719. Also the structure constructed by the Patwari Halqa concerned is not on the Forest Land or Kahcharai land which was verified by the team during the demarcation."(JNF) |
