| Recommending ineligible persons for technicians challenged | | HC stays operation of the order, issues notice to respondents | |
JAMMU, MAY 05 In a writ petition filed by Satpal, challenging the recommendation of two private respondents, who were not eligible for the post of Junior Sterilization Technicians, Justice Nirmal Singh of Jammu & Kashmir High Court Jammu wing stayed the operation of March 24, 2007 order issued by the Animal Husbandry Department and issued notice to the respondents returnable within four weeks.. Adv Manohar Singh appearing for the petitioner submitted that six posts of junior sterilization technician are lying vacant in the Government Medical College Hospital Jammu and as per rules, 75% of the posts are to be filled up by direct recruitment and 25% by promotion. For recruitment of aforesaid posts the qualification prescribed is 10+2 or above with diploma in medical assistant and one year training course in CSSD, but for inservice candidates the educational qualification has been relaxed and the promotion to the said post is made from amongst the nursing orderlies having working experience in CSSD section and running of sophisticated machinery. It is stated that private respondents have not worked in CSSD section and have no experience of running the sophisticated machinery as they are working as tailor and gate-keeper, but their cases have been recommended for promotion. Justice Nirmal Singh, after hearing the counsel for the petitioner, issued notice to respondents’ returnable within four weeks and directed that in the meantime, operation of order AHD of 679 dated March 24, 2007 shall remain stayed till the objections by the other side.
