| Special Tribunal takes serious notice of absence of JMC counsel | | | JAMMU, MAY 05 Taking strong notice of absence of the Advocate Jammu Municipal Corporation in a revision petition seeking permission to compound the construction, Mr. DK Kapoor, Judicial Member of J&K Special Tribunal, said that the representative appointed for conducting proceedings must be punctual and careful so that the Tribunal is not taken for a ride. A great responsibility is enshrined on the standing counsel appointed by the autonomous body/ Government department to remain present on each date of hearing and follow the proceedings to the logical ends, Mr. Kapoor maintained. and asked Commissioner JMC to take serious note of the absence of standing counsel and ensure that they attend this Tribunal on each date fixed by the Tribunal, failing which this will be presumed that the proceedings are being taken in a casual, cursory and perfunctory manner and that will follow the obvious consequences. These observations and remarks were passed by the Judicial Member of the Special Tribunal in a revision which has been pending since 4, 2002 and advocate for the appellant has moved an application seeking permission to compound the construction allegedly raised by him in violation of the Municipal laws but there is no body on behalf of Municipal Corporation to receive a copy and file any objections. The Tribunal ordered that a copy of the application be supplied to the standing counsel of the Municipal Corporation and obtained acknowledgement and receipt. The standing counsel for the JMC shall, however, file written objections by or before next date of hearing positively and directed that the case be listed on May 22, 2007.
