| Two Revenue officials involved in land scam granted bail | | | JAMMU, MAY 11 Special Judge Anticorruption, Jammu, Mr. Kartar Singh, today granted bail in favor of Chuni Lal and Dhian Chand, Revenue officials, involved in land scam with directions to the accused to attend the investigation as and when required by the IO. Petitioners Chuni Lal and Dhian Chand filed this bail application through Adv Jagdev Singh Jamwal, the Special Judge Anticorruption Jammu Mr. Kartar Singh called the report from Crime Branch in which it has been reported that on August 9, 2005, the complainant Kuldeep Raj lodged a written report before the SSP Crime and Railways Jammu, that land of his grand father situated at Pasgal Tehsil Bishnah and given for ploughing to one Munshi Ram of the same village, got the said land mutated in the name of his son Om Parkas, and also occupied his house and sold 7 kanals of land fraudulently by showing his name as Om Parkas s/o Griba Ram where as his real name is Om Parkas s/o Munshi Ram. On the receipt of this complaint preliminary enquiry was initiated in which it has been revealed that 19 Kanals and 19 Marlas land situated at Village Pasgal was allotted in favor of Graybar s/o Gillu Ram in 1965, who was grandfather of the complainant Kuldeep Raj. Gariba Ram executed a Will-Deed in the name of complainant Kuldeep Raj while Gariba Ram had expired in1972. After completion of enquiry, a case u/s 468, 467, 420, 471, 120-B RPC r/w section 5(2) PC Act 2006 was registered and investigation started. CPO appearing for the Crime Branch resisted the bail application that the petitioners are absconding and their arrest is necessary to complete the investigation. Special Judge Anticorruption, after hearing both the sides, observed that from the perusal of the police report it is clear that the petitioners have since retired from service. The IO proved the offences against them and nothing is to be recovered from them. Revenue record which was required for investigation has already been seized by the IO and he has reported that now only the finger prints and photographs of the petitioners are required. The IO has no where prayed for custodial interrogation of the petitioners and in the opinion of the Court such an interrogation is not necessary. Petitioners are old persons and no useful purpose would be served by sending them to custody when they are not required by the IO. They are admitted to bail, if they furnished bail bonds and personal bonds to the tune of Rs 10,000 each, with the direction that they shall attend the investigation and the petitioners surrendered before the Court for grant of bail.
