| HC dismisses petition challenging condition for transportation of food grains | | | Jammu, May 15 Justice Nirmal Singh of Jammu and Kashmir High Court Jammu wing today in a petition challenging the tender’s condition for transportation of food-grains issued by the Food Corporation of India for a period of two years has dismissed The inter-continental transportation challenging the terms of the tender notice, submitted that all the tenderers whose technical bids were also opened did not have the requisite Rake handling from the concerned institutions. However, this condition was not satisfied by the said tenderer and was not eligible for opening the price bid. The petitioner place on record the certificates issued by the Area Manger as well as senior Regional Manger FCI in favour of Ch Nagar Singh who was not having such experience of Rake handling and transportation. Justice Nirmal Singh, after hearing Advocate KS Johal appearing for the petitioner, Sr. Adv MA Goni with Adv Ajay Gandotra appearing for the respondents and perusing the record observed that when the petitioner has not participated in the tendering process, then he has no right to challenge the conditions of tender notice. Justice Nirmal Singh refereed a judgment of the coordinate bench of the State High Court and in view of the said judgment no contrary view can be taken to the interpretation already done by this Court and dismissed the petition
