| Court rejects bail of accused in murder case | | | JAMMU, MAY 16 Principal Sessions Judge, Jammu, Mr. JR Kotwal today rejected the bail application filed by accused Multan Singh facing trial in a murder case. The charges against the accused is that on November 11, 2004, he and co-accused Mohan Singh (who died during trial) caused death of deceased Dharyodan Singh by throwing him in a well after inflicting injuries with an iron rod. The accused was arrested on December 4, 2004 and since then he is behind the bar. The accused filed bail application on various grounds including that three eye-witnesses have not stated anything incriminating against him. The remaining witnesses are material. On the other hand Public Prosecutor EA Tak opposed the bail application on the ground that accused is involved in a heinous, non-bailable offence, which is punishable with death or imprisonment for life. Principal Sessions Judge, after hearing both the sides, observed that the prosecution case is mainly based upon the circumstantial evidence and none has been cited as eye-witnesses to the occurrence. Accused is not correct in saying that three prosecution witnesses have been cited as eye-witnesses. Most important is the evidence of Biaso Devi, wife of the deceased who has stated that accused Multan Singh had taken her husband from her house and after that her husband never returned back home. In face of her statement it is neither proper nor possible to discuss in detail and express opinion as regards the prosecution evidence at this stage. With these observations, Court rejected the bail application of the accused.
