| Telephone disconnected on fictitious plea | | Consumer Forum directs BSNL to pay Rs 4000 to the complainant | |
JAMMU, MAY 21 Divisional Consumer Forum, Jammu, comprising Mr. SL Pandita its President and Mrs. Minu Sharma its member, directed BSNL to make payment of Rs 3000 to complainant for having disconnected his telephone on fictitious plea and Rs 1000 as litigation charges along with Rs 100 charged from the complainant for restoration of telephone connection that had been disconnected illegally. According to complainant, Shakti Verma r/o Village Rattian, Miran-Shaib, Tehsil RS Pura, filed a complaint against BSNL through Adv Kapil Verma, in which the complainant submitted that his telephone connection was disconnected without any of his fault. On the other hand, Advocate Ravinder K Gupta appearing for the BSNL submitted that the telephone connection was disconnected as an application for voluntary disconnection of same was received by the JE of BSNL and the disconnection of telephone of complainant was voluntary, therefore, the complainant was asked to deposit reconnection charges. The judgment written by Mr. Pandita said that the facts proved deficiency of service and unfair trade practice on the part of the BSNL and speaks about the conduct of JE and SDO Miran-Sahib Exchange and then Commercial Officer-II Rani Park, Jammu. The conduct of the officials speaks for itself as to how the consumers are dealt by the officers of the BSNL. The complaint is allowed and the BSNL is directed to make payment of 3000 to complainant for having disconnected his telephone on fictitious plea that complainant had moved an application for voluntary disconnection of the telephone which was not a fact and complainant has been made to suffer mentally and physically by the BSNL Officials. The Forum also directed BSNL to repay Rs 100 charged for the complainant for restoration of telephone connection disconnected illegally. The BSNL has been further directed by the Forum rebate in the rentals from the date of disconnection and the day of restoration. The complainant is also held entitled to litigation charges of RS 1000 as he has been forced to go for litigation for none of his faults. The Forum further directed that amounts shall be deposited by the BSNL within 30 days failing which interest @ 9 per cent per annum shall accrue on the amount from the date of complaint till realization
