HC issues bailable warrants against SHO, HC Surankote

JAMMU, MAY 23
In a contempt petition filed by Shamshad Begum and her husband Bashir Ahmed, Justice Virender Singh of Jammu and Kashmir High Court, Jammu wing, has issued bailable warrants against the respondents SHO and HC Surankote for securing their presence in the Court.
Taking serious notice of non compliance of Court directions, the Judge directed that presence of both the respondents namely Ashok Kumar SHO P/S Surankote and Head Constable Mohammed Iqbal be secured through bailable warrants of arrest to the tune of Rs 10,000 each to be executed through SSP Poonch.
The contempt petition has been filed by the petitioners for initiating contempt proceedings against the respondent contemnor for willfully, intentionally and deliberately disobeying the judgment of the High Court dated March 8, 2007, it is further submitted that the petitioner being major entered into wed-lock on May 10, 2006 out of his free will. A copy of the ‘NIKAHNAMA’ was enclosed with the petition. After the NIKAH ceremony petitioners executed a marriage agreement. It has been alleged by the petitioners that from the date of marriage, the SHO and Head Constable along with father of the Shamshad Begum started harassing petitioners on one pretext or the other and an FIR was also lodged against petitioner N0 2 and his family members alleging therein that the petitioner NO 2 in connivance with the family members has kidnapped the petitioner No 1. That aggrieved by the harassment at the hands of the respondents, the petitioners were forced to file a petition in the State High Court. High Court issued notice to the respondents. During the pendency of the petition, the petitioner No 1 Shamshad Begum was taken forcibly by the SHO and Head Constable in connivance with the father of petitioner No 1 and kept her into illegal confinement. Aggrieved by the said act, the petitioner No 2 Mohammed Bashir filed a habeas corpus petition on which the High Court issued direction to respondent to produce Shamshad Begum in Court.
On March 8, 2007 in compliance of the Court order, Shamshad Begum was produced before the Court and the statement were recorded. Court disposed off habeas corpus petition. A copy of judgment was given to SHO who after going through the judgment tore-off judgment and threw it into the dustbin. They prayed for initiation of contempt proceedings against the respondents. Court after hearing Advocate IH Bhat issued bailable warrants against the respondents for securing their presence in the Court.
