JAMMU, MAY 29
Division Bench of Jammu and Kashmir High Court, Jammu wing, comprising Justice Virender Singh and Justice YP Nargotra, in a case of High Court Staff Welfare Association took serious note of non appearance of Commissioner/ Secretary Law and Commissioner/ Secretary Finance and observed that before Court could take any adverse view against both the officials for their non-appearance, Advocate PN Raina made a statement at the bar that he would cause their appearance on the next date, if need be, they would also file their affidavits.
DB after hearing Advocate PN Raina appearing for the appellants and Mr. Joginder Singh President High Court Staff Welfare Association observed that on April 19, 2007 while taking a lenient view, four weeks time was granted to the appellants for compliance of the order of March 8, 2007 directing for placing the sanction order on record failing which Commissioner Secretary Finance as well as Law Secretary should appear in person on next date of hearing. Commissioner/ Secretary Finance and the Law secretary have failed to place on record the sanction order in terms of the aforementioned order, failure makes their appearance imperative. The Commissioner/ Secretary Law department is present in person whereas Commissioner/ Secretary Finance have opted for oblivion and his non-appearance is sought to be justified on the strength of communication gap. No explanation much less satisfactory one is advanced giving cause for issuance of warrants against him. However, in view of the statement made by the counsel for the appellants that the sanction is expected within a short span, a lenient view was taken and four weeks time was granted.
Taking serious note of non compliance of the earlier Court directions and assurance given by Advocate Raina that the respondents would be present on next hearing the Division Bench has listed the case again on May 30, 2007.
