Pak national, trained terrorist, awarded 52 yrs RI

JAMMU, MAY 30
- Presiding Officer TADA/ POTA Court, Mr. Sanjay Gupta, today awarded a record sentence of 52 years to Qasim Mehmood s/o Tasyyab r/o Chak 72, Raheemyar Khan, Punjab Pakistan, who was arrested by the Army on July 15, 1994 from village Bagna, Uri, Kashmir.
The Pak-trained terrorist, who was lodged in Central Jail Agra, was produced by the police in the Court in custody. Court announced sentence in presence of Pak national terrorist.
According to the prosecution story, the accused, a Pak national, belonging to Muslim Jambaz Force (MJF) outfit crossed the LoC after getting arms training for terrorist activities, had hidden himself in village Bagna. During the search operation by the Army, accused was caught and arms and ammunition was seized from the possession of the terrorist and a case u/s ¾ TADA (P) Act, 4/5 ESA, 7/25 Arms Act and 2/3 E&IMCO was registered against him. The charges were framed earlier and today sentence was awarded.
MR Sanjay Gupta today after hearing Special Public Prosecutor appearing for the state and counsel appearing for the accused observed that the counsel for the accused prayed for lenient view while awarding sentence as the accused is young man. On the other hand special public prosecutor stated that accused is a Pak national and is a terrorist, he should be awarded maximum punishment. Court further observed that it is fact that accused is a young man and wants to live peacefully so keeping in view whole circumstances of the case, the accused is sentenced to undergo rigorous imprisonment for 10 years under u/s 3 of TADA, 10 years u/s 4 of TADA and a fine of Rs 5000, 10 years RI and fine of Rs. 5000 u/s 7/ 25 Arms Act, another10 years and a fine of Rs 5000, u/s 4 of ESA, 10 years and a fine of Rs 5000 u/s 5 of ESA and two and a fine of Rs 2500 u/s 2/3 E & IMCO (Egress and Internal Movement Control Ordinance). The Court ordered that all the\ sentences shall run concurrently and directed that a copy of this order shall also be sent to Superintendent Central Jail Agra.
