| Special Tribunal issues non-bailable arrest warrants against Custodian EP | | | JAMMU, MAY 31 Mr. DK Kapoor, Judicial Member J&K Special Tribunal Jammu, today issued non-bailable warrants against Abdul Majid Wani, Custodian Evacuee Property Jammu for securing his presence before the Tribunal and the warrants sent to SSP Jammu for execution. The warrants were issued in contempt proceedings initiating against Custodian Evacuee Property in a case filed by the Department of Agriculture in which it has been submitted that Custodian in order to recover the rent for the leased out piece of land to agriculture department, directed the Branch Manager J&K Bank to transfer the entire money lying in the account of agriculture department in account of the Custodian Jammu. The concerned branch manager complied with the direction and transferred a sum of Rs 42, 28, 649. The joint director agriculture approached the tribunal, the tribunal after hearing both the sides struck down the order of Custodian Jammu and directed to him to return the said amount to account head of Director Agriculture Department within five days. It was found that the Custodian Jammu has not cared to deposit the said amount and as a petition for initiating the proceedings of disobedience of order of this Tribunal was moved on behalf of the agriculture department, a show cause notice was issued to Custodian Jammu to remain personally present on May 25 to explain as to why he should not be punished for the contempt. On said date Wani Custodian EP Jammu appeared along with Advocate MA Bhat, proceedings were taken in presence of Advocate SA Malik for the petitioner and made a statement at the Bar that the amount could not be arranged and requested for further extension, assuring tribunal that he shall deposit the said amount by or before May 31, 2007. After considering all the facts and circumstances, Mr Kapoor observed that since the custodian Jammu has intentionally and willfully absented himself and failed to file any written rejoinder to the notice issued to him, issued non-bailable arrest warrants for securing his presence before the Tribunal and warrants sent to SSP Jammu for execution
