Ex-Chief Engineer granted pre arrest bail

Special Judge Anticorruption, Jammu, Mr. Kartar Singh today granted pre-arrest bail in favour of Hari Krishan Koul ,a retired Chief Engineer, who is involved in FIR NO 2/ 2007 registered by the Vigilance Organization Jammu on his furnishing bail bond and personal bond to the tune of Rs 10, 000 each with certain conditions.
Mr. Hari Krishan Koul filed this bail application for seeking bail in anticipation of his arrest. In the application it is pleaded that he is retired Chief Engineer and was summoned by the P/S VOJ Jammu that FIR offence for offence u/s 5(2) r/w section 120-B RPC has been registered. He apprehends his arrest in the said case and prayed for bail in anticipation of his arrest.
According to the report of the VOJ during the period 2003-2005 fluorinate concrete hardeners was purchased by the PWD R&B Div Udhampur in the month of April/ May 2003. This was purchased by Mr. Puran Bharat Gandhi the then Xen after entering into criminal conspiracy with M/S Nazir Ahmed Tramboo, Raj-bagh, Srinagar, M/S Zaffar Iqbal Mohalla Afgahana Jammu and M/S Hindustan Paints Udhampur. In furtherance of the said criminal conspiracy 116 qtls of FCH was purchased from the above named three firms at highly exorbitant rates of Rs 44 per kg. Similarly Mr. Dharam Vir Koul the then Xen also conspired with the suppliers firms M/S Hindustan Paints Udhampur and M/S A D Choudhary Magarmal bagh Srinagar and purchased 240 qtls FCH @ Rs 44 Per KG. Mr. Hari Krishan Koul the then SE PWD (R&B) Circle Udhampur also dishonestly purchased 50 qtls of FCH @ Rs 44 per KG from M/S Alla-Ud-Din Gandhi Nagar Jammu. It was further found during the verification that actual rate of FCH was only Rs 4 per KG. The case is very serious in nature and if the petitioner is admitted to bail, he will temper the evidence prayed by the VOJ.
Special Judge Mr Kartar Singh, after hearing Advocate PN Raina appearing for the petitioner and CPO for the Vigilance Organization, observed that from the perusal of the report, it appears that the alleged occurrence took place in the year 2004 and petitioner stated to have purchased FCH at highly exorbitant rates. It has nowhere been asserted by the VOJ that any custodial interrogation of the petitioner is required. The investigations of the case primarily revolve upon seizure and perusal of the records which are neither in the custody of the petitioner nor in his control and as such, does the possibility of tempering with the evidence does not arise at all. No useful purpose will be served by sending him to custody, he is therefore, admitted to bail on his furnishing bail bond and personal bond in the amount of Rs 10, 000 each with the condition that he shall attend the investigation as and when required.
