Prosecution failure leads to acquittal in murder case | | | Early Times Report
Jammu, Mar 7 : Principal Sessions Judge Jammu R S Jain today acquitted one Roshan Lal of Chattisgarh who was facing trial in murder case, as prosecution failed to prove the allegations. After hearing Adv Rohan Nanda appearing for the accused, Principal Sessions Judge Jammu RS Jain observed that circumstances reflected from the material on record don't stand conclusively established. "The facts are also not consistent only with the hypothesis of the guilt of the accused. The material brought on record by the prosecution is insufficient to hold that the accused is guilty beyond reasonable doubt, the court said and further added that in view of this, Court hereby held that the prosecution has failed to bring home the charge against the accused person for the offence under Sections 302 RPC. Henceforth accused Roshan Lal s/o Bhoj Lal r/o Jhanjghir Champa, Chattisgarh is hereby acquitted of the charge under Sections 302 RPC and directed accused who is in judicial custody, be released if not required in any other case. As per prosecution case on 14/2/2011 complainant Amit Gupta filed a written complainant in police station R S Pura that he has a plot in W-12 R S Pura and had raised three rooms therein and that Roshan Lal and Ishwar have been residing in the said plot for 3 months. Today, his driver informed him that the dead body of Ishwar is lying in the plot and that Roshan Lal is absconding. On receipt of the complaint, FIR No.124/2011 for offence u/s 302 RPC was registered in police station R.S.Pura and after completion of investigation challan was presented. (JNF) |
