| Children hospital building collapse case | | Court awards damage of Rs 2 lakhs after 19 years of litigation | |
JAMMU, JUNE 11- Additional Sessions Judge, Jammu, RS Jain in a much publicized children hospital building collapse case in 1998, in which several children including wife and son of the petitioner had died, has passed decree of Rs 2 lakhs along with interest. This people's friendly judgment passed in a suit filed by one Sunder Dass and others in which it has been submitted that the son of the petitioner Kuldeep Raj age 14 years (at that time) was admitted in the children hospital Jammu for treatment on April 26, 1988 and Santosh Kumari w/o of the petitioner was also in the same hospital as she had to look after her ailing son Kuldeep Raj. It has been further submitted that on May 2, 1988 hospital building collapsed and Kuldeep Raj and Santosh Kumari came under the debris of hospital building and died on spot. The names of dead-bodies of the deceased were in the list prepared by the authorities. It is alleged that the hospital building collapsed due to the negligence of the respondents who had declared the building as fit and had not cared to see whether the material used in the construction of the building was standard and the building feel down just about 2 years after its completion.. Additional Sessions Judge ,after hearing Advocate BM Gupta appearing for the petitioners and Additional Public Prosecutor Mr. Ravinder Sharma appearing for the state, and also referred various judgments of the Supreme Court observed that hospital building collapsed due to the negligence of the respondents and in the said collapse petitioner's wife and child expired, as such decree is passed in favour of petitioners and against the respondents whereby petitioners are entitled to damages of Rs 2 lakhs along with pendente-lite and further interest @ 7 per cent till realization of the amount.
