Court dismisses bail application of accused facing trial under NDPS Act

JAMMU, JUNE 11- The 3rd Additional Sessions Judge, Jammu, Mr. Sanjay Gupta rejected the bail application of Mehraj Din Bhat s/o Mohd Ramzan Bhat r/o Bandipora Tehsil Bijbehara District Anantnag, who is facing trial under NDPS Act for possessing 8 Kg of Charas.
Additional Public Prosecutor Gulzar Singh Charak submitted in the objections that accused, who was found in possession of 8 Kg of charas, which is commercial quantity has been charge-sheeted u/s 18/ 20 of NDPS Act and the punishment for these offences is up to 20 years and a fine Rs 2 lakhs. The accused was arrested on February 7 last along with the charas at Marakhadi Morh Gangyal from a TATA Sumo.
Mr. Sanjay, after hearing both the sides, observed that menace of drug trafficking is causing serious threat to the society and the Court must adopt negative attitude towards bail. He said section is clear that no person can be released on bail unless Court is satisfied that there are reasonable grounds for believing that he is not guilty of such offence and he is not likely to commit any offence while on bail. The prosecution has yet to produce prosecution witnesses. The contention of the Advocate PN Raina appearing for the petitioner/ accused that there is contradiction in the statement of the witnesses already examined, cannot be taken into consideration at this stage because it can be appreciated only after full trial. It is the duty of the Court to curb drug trafficking, which is at present causing threat to society. Keeping in view whole circumstances of the case the bail petition is dismissed.
