| Bail application of accused involved in murder case rejected. | | | JAMMU, JUNE 12:- Principal Sessions Judge Jammu Mr. JR Kotwal rejected the bail application filed by Sat Pal Singh and Jasbir Singh, who are facing trial in a murder case. According to the prosecution story the accused persons are facing trial u/s 302, 307, 324, 323/ 34 RPC and accused Sat Pal Singh is also charged u/s 4/25 Arms Act. Allegations against them are that on June 23, 2001, armed with weapons and a gun, they attacked on Gyan Singh, Jasbir Singh and Kulbir Singh. One of the accused Jasbir Singh shot dead Kulbir Singh with his double barrel gun. Principal Sessions Judge, after hearing Advocate Surinder Singh appearing for the accused persons and public Prosecutor Mr. EA Tak appearing for the state and on the observed that in so far as delay in completion of prosecution evidence is concerned, this Court had taken its due note and has vide order dated May 10, 2007 made it clear that it is duty of the prosecution to lead evidence at the trial though the summons are issued by the Court to assist the prosecution. This Court has involved SSP Jammu and the concerned SHO in service of the witnesses. Outcome of the order passed by this Court on May 10, 2007 would be seen during the next calendar for hearing on July 9 and 10, 2007 as such the prayer for bail is rejected. It was made clear by the Court that this order will have no effect on the interim bail granted to applicant Gurdeep Singh.
