| HC stays transfer order of veterinary doctor | | | JAMMU, JUNE 14- Justice YP Nargotra of Jammu and Kashmir High Court, Jammu wing, in a writ petition filed by Dr. Rakesh Koul, Veterinary Assistant Surgeon, challenging the transfer orders within less than a month, has stayed the impugned order dated May 25, 2007 in view of the concession made by Additional Advocate General Mr. BS Salathia. Justice Nargotra, after hearing Advocate Surinder Kour appearing for the petitioner Dr. Rakesh Koul, issued notice to State government through Secretary Animal Husbandry and Director Animal Husbandry Jammu. AAG Mr. Salathia submitted that he does not oppose the prayer of the petitioner at this stage for grant of stay of impugned order dated May 25, 2007. Court while staying the impugned order further observed that in view of the concession made by AAG Mr. Salathia, the order impugned shall remain stayed till further orders. During the course of arguments Adv Surinder Kour appearing for the petitioner submitted that Dr. Rakesh Koul is working as Veterinary Assistant Surgeon for the last about 14 years and was attached in the office Poultry Nutritionist, Belicharana Jammu and vide order dated April 27, 2007, the petitioner was transferred and posted as Poultry Extension Officer Belicharana and joined the new place of posting. The respondents issued a corrigendum on May 25, 2007 whereby the petitioner was allowed to remain attached in the office of Poultry Nutritionist Belicharana instead of Poultry Extension Officer Belicharana. The action of respondents is arbitrary, illegal, wrong and unconstitutional seeking quashment of the said order on various grounds. Justice YP Nargotra after considering the facts and circumstances of the case and in view of the concession made by AAG BS Salathia stayed the impugned order dated May 25, 2007 till further orders.
