| Court grants bail to alleged murderer of wife | | | JAMMU, JUNE 16 Principal Sessions Judge Jammu Mr. JR Kotwal granted bail to Ganesh Dutt, who is facing trial in a murder case. While grating bail Principal Sessions Judge, after hearing Public Prosecutor appearing for the state and Advocate Koushal Parihar appearing for the accused, Mr. Parihar submitted that statement of all the eye-witnesses have been recorded and their evidence shows that no offence much less and offence u/s 302 RPC (murder) has been committed by the accused. In the reply PP submitted that prosecution evidence could not be appreciated at this stage. The allegation against the accused is that he hit his wife chapatti roller on her head and thereby caused her death in the intervening night of May 22/23, 2003 and since then the alleged accused is under arrest. Court further observed that after a careful perusal of entire evidence in particular statements of eye-witnesses, Court is of considered view that bar to bail in case offence punishable with death or life imprisonment as offence u/s 302 RPC is not attracted in this case though the Court abstains from commenting any observation that may tend to expression of opinion about appreciation of evidence at this stage. Accused is in incarceration from last about more than four years and Court is of considered view that accused is entitled to bail now. With these observations, Court allowed bail application of the accused and ordered that accused shall be released after he furnishes a personal bond along with a surety in the amount of Rs 20,000 each.
