Governor suggests introduction of legal insurance scheme

Chief Justice of India Mr. K. G. Balakrishnan has called upon the state Chief Ministers to provide better infrastructure for courts so that efficacy of justice delivery system enhances.
He said that the institution of Village Nyay Adhikaris would help in speedier disposal of cases at village level and also create awareness in people about their legal rights.
Launching the legal awareness campaign at SKICC here today, Mr. Justice Balakrishnan underlined the need for sensitizing the judicial officers to justice delivery system accessible to the poor and needy.
He said the judiciary system is essentially based on the principles of natural justice and unless the system is made accessible to poor and needy, it would lag behind in providing justice to all. He said that Legal Services Authority has come in to being for this purpose so that affected persons, poor and deserving get their legal rights protected.
He said some two years back national legal service literacy campaign was launched by Prime Minister Dr. Manmohan Singh to make country aware of their rights and free legal aid service available to them.
Governor Lt. Gen. (Retd.) S K Sinha in his presidential address gave a resume of historical evolution of justice system in the world and suggested measures for reducing delay in justice delivery system. He said that poor, needy and destitute must be provided legal aid to protect their rights. He also suggested a mechanism of making police verification speedily so that delivery of justice is expedited. He said instead of taking recourse to prolonged deliberations, minor cases could be resolved in minimum time if police functioning is reformed.
Chief Minister Mr. Ghulam Nabi Azad in his speech said that confidence in judicial system hinges on the expectations that justice is delivered expeditiously, effectively and transparently.
Stating that speedy justice is a fundamental right flowing from the right to life, he said, "it is our duty to render fearless, impartial and quick justice to the needy".
Chief Minister said justice delivery system is under an obligation to deliver prompt and in-expensive justice. He said that the contribution of Indian judiciary in enlarging human rights is unparalleled.
Mr. Azad, however, said that poor and downtrodden people are unable to get their rights enforced owing to high cost in seeking justice from the courts, as such, to reinforce the faith of people in justice delivery system, it has to be quick and in-expensive. He said alternative dispute resolution mechanism to settle cases speedily is a reliable system which provides ample opportunities to poor and needy to resolve disputes effectively.
He said the concept of resolving dispute through arbitration is not new to Indian people and that Lok Adalats are providing a supplementary forum for the settlement of disputes through conciliation. He said Jammu and Kashmir enacted Arbitration and Conciliation Act to encourage mediation and conciliation. The process of mediation and conciliation is faster and cheaper method of dispute resolution as compared to the conventional court process.
Chief Minister suggested establishment of mediation and conciliation centres at district level adding that panchayats and local bodies could play an effective role in settlement of disputes. However, he said mediator must be selected on the basis of qualities like skill, tact, art of persuasion and behaviour. They should be people with unimpeachable integrity and conviction.
