| HC grants interim bail to IRCON Engineer | | | JAMMU, JUNE 21- Vacation Judge of Jammu and Kashmir High Court, Jammu wing, Justice JP Singh today granted interim bail for a period of 15 days in favour of IRCON Engineer Vinod Kumar, who was caught red-handed by the CBI on June 13 last while accepting bribe of Rs 15000 from a contractor in Banihal for releasing payment amounting to Rs 1.50 lakhs for the work executed on railway line. While granting bail, Justice JP Singh after hearing Advocate Charanjit Kumar appearing for the petitioner, observed that petitioner was arrested on 13th of this month in a case registered by CBI. Counsel for the petitioner submitted that the designated judge, who was to deal with the bail application of the petitioner, was not available because of vacations and it was because of this reason no application was moved by the petitioner before the designated judge. Counsel for the petitioner seeks petitioner’s release on bail saying that nothing more remains to be investigated in the case as the alleged bribe amount had been recovered by the respondent (CBI). Earlier, he approached the duty magistrate for his release. Objections filed by the CBI before the Duty Magistrate indicates petitioner’s arrest in the case on June 13, 2007 u/s 161 RPC and 5(2) of J&K PC Act 2006 when an amount of Rs 15000 was recovered from him on a trap laid by CBI and petitioner is in custody of the CBI for over a period of one week. Justice JP Singh further observed that Court considered the submissions of counsel for the petitioner and have gone through the objections filed by CBI before the Duty Magistrate. Considering the facts and circumstances of the case and non-availability of the designated judge where the petitioner could file his bail application, the Court consider it just and proper to admit the petitioner, arrested for commission of offence u/s 161 RPC and 5(2) PC Act 2006, to interim bail for a period of 15 days on his furnishing personal recognizance and a surety in the amount of Rs 20,000 to the satisfaction of Registrar Judicial of High Court. Court further ordered that petitioner shall surrender in this Court on July 6, 2007.
