| Assistant Surgeons challenged Govt order | | HC stay the Govt order restraining petitioners from pursuing PG Courses | |
JAMMU, JUNE 22 Vacation Judge of Jammu & Kashmir High Court Jammu wing Justice JP Singh today in a batch of writ petitions filed by Assistant Surgeons who are pursuing the post-graduate courses in various medical colleges of the state, has order that Govt order dated June 15, 2007 shall not effect the service status of the petitioners. In the writ petitions, the petitioners who are Assistant Surgeons have been appointed by the Govt and are pursuing the post graduation course in various medical colleges of the state. The respondents state have issued the order impugned to the extent it directed that the appointment of the petitioners as Assistant Surgeons shall be deemed to have been rescinded in case they continue pursuing their post-graduate courses and do not join the place of posting as directed in the order dated June 15, 2007. The petitioners represented before the respondents with a prayer that the order impugned is arbitrary and filed this petition seeking quashment of the impugned order. Justice JP Singh after hearing Sr. Adv AV Gupta with Advocate Yaseer Ejaz Tak appearing for the doctor Sohit Paul Kanotra and 19 other doctors, in other writ petition filed by Dr. Sonam Kumari and 12 others doctors in which Sr. Adv UK Jalali with Adv Vishal Goel appeared whereas in a writ petition filed Dr. Amit Sahni in which Adv Ajay Sharma appeared for the petitioners and Deputy AG Mrs. Shaista Hakim appearing for the State respondents, observed that petitioner’s counsels referred submitted an order passed by a Single Bench of the Srinagar wing n June 20, 2007, has issued notice to the state respondents for filling objections and in the meanwhile Govt order No 404-HME of 2007 dated June 15, 2007 shall not effect the service status of the petitioners.
