| HC stays doctors’ transfer order | | | JAMMU, JUNE 25- Vacation Judge of Jammu and Kashmir High Court, Jammu wing, Justice JP Singh today issued notice to the respondents and in the meantime stayed the transfer order of Assistant Surgeon Dr. Dara Singh from Medical Education to Directorate of Health Services Jammu. This Court order has been passed in a writ petition challenging the order of Director Health Services Jammu dated June 12, 2007 whereby the petitioner was directed to join the directorate of health services Jammu. In the writ petition filed through Advocate Kuldeep Singh Parihar it has been submitted that petitioner filed a writ petition in the state High Court in 2004, and the Court in its interim order passed on February 16, 2004, issued notice and in the meanwhile directed that status-quo with regard to the service status of the petitioner be maintained till objections are filed and considered. The state preferred LPA in the High Court and on which the Division Bench passed it directions and the Principal GMC Jammu in pursuance of the said judgment issued reliving order on March 1, 2006 to the petitioner who was undergoing studies in Sher-i-Kashmir institute of Medical Sciences, Soura, Srinagar as MD in Hospital Administration. It is further submitted that some of the respondents in the said LPA preferred SLP in the Apex Court and stayed the impugned order. Despite the interim order of the Supreme Court, the respondent ordered transfer of the petitioner from Medical Education to Directorate of Health Services, the petitioner seeking quashment of order dated June 12, 2007 issued by Health services Jammu. Vacation Judge Justice Singh, after hearing Adv Kuldeep Singh Parihar appearing for the petitioner, issued notice to respondents State through Chief Secretary Commissioner/Secretary Health and Medical Education, Director Health Services Jammu and Principal GMC Jammu and in the meanwhile stayed the operation of the impugned order till next date of hearing.
