| Petition seeks registration of case against ADC Udhampur | | HC issues notice to AG, respondent State | |
JAMMU, JUNE 27- Vacation Judge of Jammu and Kashmir High Court, Jammu wing, Justice JP Singh, in a petition filed by one Sajjad Hussain ex-Sarpanch of Village Basht Tehsil Chenani leveling serious allegations against Additional District Development Commissioner Udhampur Khurshid Ahmed Bhat, has issued notice to Advocate General and also to respondents State through Commissioner/Secretary Home Department, DGP, IGP Crime and Railways, SSP Udhampur, SHO Chenani, DC Udhampur and Additional District Development Commissioner Udhampur for July, 2007.
In the petition it has been submitted that on June 1 last, DC Udhampur had to go to Chenani to sort out the water dispute with the locals and accordingly the petitioner, along with some other persons, was standing on the road waiting for arrival of the DC At about 5:30 in the evening the DC along with ADDC Udhampur came on spot and started taking to the people. The petitioner being the ex-sarpanch also started taking to the DC, meanwhile the ADC Udhampur Khurshid Ahmed Bhat interfered in the matter and instigated the people of the other party and directed them to throw the petitioner from the bridge into the Nallah. Ghulam Mohammed, Mohammed Shakeel, Rayees Ahmed, Farad Ahmed, Toyees Ahmed and others suddenly attacked the petitioner and threw the petitioner in the Nallah but was saved by one Mohan Lal. The petitioner received several injuries and moved an application in P/S Chenani for registering case against the Additional DC but no action was taken against the erring officer
In the petition it has been submitted that the matter requires investigation by a senior Investigation Officer as the ADC enjoys influence over all the P/S in the District. The petitioner prayed before the Court for issuance of directions to the respondent to register a criminal case against ADC and other persons who were involved in a criminal act committed at the instance of respondent and also seeking direction to Commissioner/Secretary Home Department to get the matter investigated through IG Crime and Railway Jammu
