JAMMU, JUNE 28:- Vacation Judge of Jammu and Kashmir High Court Jammu wing Justice JP Singh today in a habeas corpus petition issued notice to SSP Doda for July 23, 2007 for status report regarding the whereabouts of Abdul Hafiz alias Bashir s/o Ghulam Hussain r/o Village Koti District Doda.
This Court direction has been passed in habeas corpus petition filed through the father of Abdul Hafiz through Advocate Haffeez-Ur-Rehman in which it has been submitted that while the petitioner was on his way to Jammu from his village and before reaching Doda City from where he has to board the bus to reach at Jammu to attend the Court, suddenly four persons appeared on the scene along with guns and directed the petitioner to accompany with them. The petitioner who was accompanied by his father refused to oblige the said person on the plea that he has to appear before the Court at Jammu as his presence is required in the Court on June 8, 2007. The private respondents insisted and even threatened with dire consequences and openly said that they being members of the Village Defence Committee can do whatever they want and even he can be eliminated. The respondents took away the petitioner Abdul Hafiz alias Bashir along with them and took him to unknown place, the father of the petitioner begged for the release of petitioner but all in vain.
The father of the petitioner went to police station to lodge an FIR with regard to said happening, no FIR was registered though the father of the petitioner named persons who abducted the petitioner. In the petition it has been prayed for issuance of directions to produce the petitioner before this Court.
