| Court rejects bail application of accused involved in killing his wife | | | JAMMU, JUNE 29 1st Additional Sessions Judge, Jammu, Mr. Puneet Gupta dismissed the bail application of accused Vishal Shivgotra facing trial in committing murder of his wife. The accused is alleged to be involved in the murder of his wife and allegedly made a statement before the police confessing that he had took the life of his wife by strangulating her. The investigation which took place on the basis of his statement has led to the filling of challan u/s 302 RPC (murder) against the accused. Mr. Puneet Gupta, after hearing Adv JP Nanda for the petitioner accused and APP Harpal Singh appearing for the state, observed that Court cannot anticipate what sort of evidence is going to come on record from the witnesses who are yet to be examined in the case. The evidence which is yet to be produced by the prosecution is not going to survive the case of the prosecution and the case is mainly dependent upon the confession made by the accused before the police and the circumstantial evidence which may connect the accused with the commission of offence, the Court observed. Apparently some of the witnesses have not given evidence in support of the prosecution and at the same time Resham Kour mother of the victim has deposed regarding maltreatment and indifferent attitude of the accused towards the victim during her lifetime. Court observed that it would be premature to admit the accused on bail at this stage when some of the important witnesses are yet to be examined. The gravity of offence is indeed a factor which has to be seen by the Court while considering the application for bail. With these observations, Court dismissed the bail application of the accused petitioner.
