Srinagar, June 12: Division Bench of Justice M H Attar and A M Magrey directed state government to preserve nearly 180 kanals of land retrieved by it from unauthorized occupants in Gulmarg, the world famous tourist resort in north Kashmir's Baramulla district.
The division bench also directed that 'open (un build) land' in the Gulmarg shall not be used for any purpose and no construction shall be raised on it till further orders from the court.
Court has directed government to preserve nearly 180 kanals of land retrieved by it from unauthorized occupants in Gulmarg, the world famous tourist resort in north Kashmir's Baramulla district. The court also sought information from government about the action taken by it regarding unauthorized occupation of over 175 acres of land by army at Gulmarg.
The directions were passed when the hearing was taken up a Public Interest Litigation (PIL), a Division Bench of Justice M H Attar and A M Magrey also directed government that land' in the Gulmarg shall not be used for any purpose and no construction shall be raised on it till further orders from the court.
The Division Bench passed the directions after the perusal of a status report by the Commissioner Secretary Tourism and Culture Department, informing that 179 kanals and 19 marlas of land, which was earlier under unauthorized occupation, has been retrieved now by the Gulmarg Development Authority (GDA). "The retrieved land shall not be dealt with in any manner whatsoever by the state authorities and same shall be protected and preserved in the present form till further orders from the court," the Division Bench said.
The Commissioner Secretary also informed that as per revenue records, Gulmarg has 15494 and 13 marlas of land, of which about 2425 kanals is the built up area.
The division bench also sought information from government about the action taken by it regarding unauthorized occupation of over 175 acres of land by army at Gulmarg.
The Division Bench also directed Jawad Ahmad, Additional District Judge (Presiding Officer), Motor Accidents Claims Tribunal (MACT), Srinagar, to visit Gulmarg and report about the repairs, which are required as per a list of hotels or establishments provided by the CEO to the court in compliance to its direction.
"The GDA shall provide copy (list) and also necessary assistance as may be required by the Additional District Judge for verifying the report," the court said and directed the Judge to make recommendations to the CEO, GDA, "who shall process such cases for grant of permission for effecting repairs or renovations in the structures and the hotels."
The court also directed Member Secretary to Pollution Control Board (PCB) to file an affidavit before nest date of hearing in the PIL on July 23, indicating action taken in pursuance of a communication by the PCB to owners of hotels about the encroachment of forest land for setting up of Sewerage Treatment Plant (STP) by them. It also directed Principal Chief Conservator of Forests to file an affidavit indicating how much area of Gulmarg valley has transferred to GDA.
Meanwhile the court while disposing of a petition left it for the Competent Authority in the Government to take decision within eight weeks on running of Snow Mobile Bikes in Gulmarg.
