Murder case decided after 15 years trial
Court awards life imprisonment to three accused and acquits 15 others

JAMMU, JUNE 30- 2nd Additional Sessions Judge, Jammu, Mr. AK Koul, today in a cold blooded murder case, awarded life imprisonment to accused Satpal s/o Indru Ram, Joginder Lal alias Aleko, both residents of Chinore and Naresh Kumar alias Numbri r/o Moti Bazaar Jammu and acquitted 15 other accused facing trial from 1992.
According to the police on May 19, 1992 one Suraj Singh had lodged a verbal report in police station Domana alleging therein that Jagatar Singh has been murdered. On this information, case u/s 302/ 452/149 RPC r/w section 3/25 Arms Act was registered and investigation taken up.
The investigation team revealed that around 10.30 PM assailants armed with guns entered in the house of deceased with the common object to kill the deceased, fired at him and killed him on spot while father of the deceased got injured. In the process it has been alleged that deceased was not enjoying good relations with the accused party. After collection of oral as well as documentary evidence investigation found that one Ashok Singh had sought help of accused Mohan Lal and Kaki to sell some land and it was agreed that he would pay commission of Rs 10,000. Some of the land was sold by Mohan Lal and Kaki but they failed to pay the money to Ashok Singh. It was further stated that the annoyed Ashok Singh along with deceased, Om Parkash and Vinod Sharma went to negotiate with Mohan Lal and Kaki. Negotiation ended in a quarrel and deceased slapped the accused Mohan Lal, a relation of the accused Joginder Lal. Mohan Lal and Kaki threatened the deceased that they would manage his murder through accused Joginder Lal, a life convict. This gave birth to a designed game plan. Accused Mohan Lal and Kaki managed the release of accused Joginder Lal (life convict on parole). They also acquired arms to facilitate for murder of deceased. An attempt to kill the deceased made by Naresh Kumar, Joginder Lal, Ranjeet Singh, Ashok Kumar, Kaki and Fouji failed because deceased could not be traced.
One Ram Lal, who was himself history-sheeter, arranged a meeting of accused Joginder Lal, Babu Ram, Ashok Kumar, Baldev Raj on May 16, 1992. It is alleged that conspiracy to kill deceased was hatched in the meeting. All the accused assembled in the house of accused Krishan Dutt and the later had paid Rs 5000 in advance for the murder of deceased. Accused Rattan Lal identified the house of deceased to accused Joginder Lal. On the fateful day accused Joginder Lal managed to resort to firing through accused Satpal at Chinore Chowk simply to divert the attention of police from the place of occurrence and on May 19, 1992 at about 10:30 PM accused in common object forced entry in the house of deceased and shot him dead in presence of his wife Naresh Kumari. The accuse fled away from the place of occurrence, it was so concluded by the investigating agency that accused killed the deceased in a pre-arranged plan, after hatching a conspiracy and also made an attempt to kill the father of the deceased.
After completion of the investigation charge-sheet was presented u/s 302/307/460/148/149/120-B, 216 RPC and 3/25, 4/27 and 3/27 Arms Act.
In the 56 pages judgment, 2nd Additional Sessions Judge, after hearing APP Mr. Ravinder Sharma and Advocates Sunil Sethi, MM Gupta and ML Thusoo appearing for the accused persons, observed that this is a live example of delayed justice, occurrence took place in the mid of 1992 and the case has reached final phase in almost one and a half decade and held guilty Sat Pal, Joginder Lal and Naresh alias Numbri for commission of offence u/s 302/460/34 r/w section 120-B RPC and in addition to these offences accused Sat Pal and Naresh alias Numbri are also guilty of offence 3/25 Arms Act and other accused are acquitted from the charges.
On the quantum of punishment, the Court today after hearing both the sides, awarded life imprisonment to Sat Pal, Joginder Lal alias Aleko and Naresh Kumar alias Numbri with the observations that it is not a case which could be called as rarest of the rare. Court believes that chances of reforming the accused are still left and awarding death penalty would be expression of judicial anger. So after considering all the relevant material the accused Sat Pal, Joginder Lal and Naresh Kumar alias Numbri shall undergo imprisonment for life u/s 302/34 RPC and shall also pay a fine of Rs 5000 each. The three accused also found guilty u/s 460 RPC and awarded imprisonment for five years and fine Rs 1000. Accused Sat Pal and Naresh Kumar alias Numbri are also sentenced to imprisonment for two years and a fine Rs 1000 each for commission of offence u/s 3/25 Arms Act. Court clarified that all the sentences shall run concurrently.
