| Alleged forged ‘will’ fabricated after the death of lady | | HC directs AAG to file status report | |
JAMMU, JULY 02:- Justice JP Singh of Jammu and Kashmir High Court, Jammu wing, today in a petition, in which it has been alleged that a will’ was fabricated after the death of aunt of the petitioner, has directed Additional Advocate General Mr. BS Salathia to file status report as to what steps the concerned police agency had taken, pursuant to the orders passed by the CJM in the matter. The status report shall be filed along with affidavit of Sub Divisional Police Officer Akhnoor. This Court direction has been issued in a petition filed by one Gharu Ram r/o Village Bardhal Kalan Tehsil Akhnoor District Jammu in which petitioner submitted that Shatto Devi was real aunt of the petitioner, Shatto Devi died on March 2, 2001 at her house who was issueless and owned a house and possessed agriculture land in the said village. The petitioner performed the last rites. The petition further disclosed that Sikander Singh and Mohan Lal of the same village on April 8, 2001 asked the petitioner to sign on a blank paper because the petitioner, earlier Sikander Singh, to get some loan sanction in his favour and Sikander Singh was working in rural bank so in good faith the petitioner signed on the papers hoping that he will so get the loan from the bank. After three days Sikander Singh along with a person came to the house of the petitioner and tried to occupy the land left by Shatto Devi (bua of the petitioner) forcibly declaring that Shatto Devi has executed a will in their favour. It has been alleged that will is a forged document as Shatto Devi died on March 2, 2001 and the will was fabricated on March 15, 2001 and registered on April 9, 2001. It clearly shows that the will has been fabricated after the death of Shatto Devi. As such a forged document has been procured and other lady has been produced in the Court for registration of will at the time fabrication of will as Shatto Devi was already died. Sr. Adv SS Lehar with Adv Akshay Anand appeared for the petitioner seeking direction for registration of a case against the alleged accused for fabricated forged documents. Justice JP Singh after hearing the advocates issued notice to State of J&K through Commissioner//Secetary Home, SSP Crime Branch Jammu, SDPO Akhnoor, SHO Akhnoor, the notices accepted by AAG on behalf of the said respondents. Court also issued notice to Sikander Singh and Mohan Lal private respondents. JNF
