| Controversial selection of 505 JE Civil challenged | | HC imposes Rs 21000 cost on petitioners | |
JAMMU, JULY 04:- Justice Nirmal Singh of Jammu and Kashmir High Court, Jammu wing, in a much publicized selection of 505 JEs, today directed that in case the publication charges are not deposited along with cost Rs 21000 within the stipulated period then the petitioners’ quo the non-serving respondents shall stand dismissed without further reference to the bench. Before issuing this direction, Justice Singh after hearing Advocate Abhinav Sharma and Adv Surinder Kour appearing for the petitioners and Additional Advocate General SC Gupta for the official respondents and Advocate Anil Sethi appearing for the private respondents, further observed that publication charges have not been deposited. Counsel for the petitioners seek and are allowed four days more time for depositing the publication charges. But this is subject to the deposit of cost of Rs 3000 in each petition (total seven petitions), the same be deposited in the Advocate Welfare Fund. Earlier Justice Hakim Imtiyaz Hussain after considering the facts and circumstances of the case modified the order of April 19, 2007 to the extent that state respondents are free to make postings of the appointed candidates but with the conditions that postings shall not confer any benefit on the selectees /appointees. The posting shall be without pre-judice to the petitioner’s rights which may be determined at the final disposal of these petitions and also dispensed the presence of Commissioner/Secretary PWD but the record of selection/appointment shall be made available on the next date of hearing which was fixed in the first week of July, 2007 along with connected petitions.
