| Widow of SRTC employee struggling for pension since 1975 | | HC Issues bailable warrants against Commissioner/Secretary Transport | |
JAMMU, JULY 10- Justice Nirmal Singh of Jammu and Kashmir High Court Jammu wing in a petition filed by a widow of an employee of SRTC summoned Commissioner/Secretary Transport through bailable warrants in the sum of Rs 10,000 and directed respondents to pay the provisional pension to the petitioner, as the husband of the petitioner, as per the averments made in the petition had served for 27 years on regular basis. The provision pension should be paid to the petitioner before the next date of hearing. These directions have been passed in a petition filed by one Kamala Devi in which she stated that her husband died on March 5, 1975 after rendering about 27 years of service in the Government Transport Undertaking which was converted into J&K State Road Transport Corporation in the year 1979. The employees of the erstwhile Government Transport were given opportunity to exercise their option by drawing the pensionary benefits applicable to the permanent Government employees. The husband of the petitioner died before passing of the Government order of 1979. The petitioner prayed for issuance of direction to the respondents to release the pensionary benefits in favour of the petitioner. Advocate Abhinav Sharma appeared for the petitioner, Deputy AG AS Dogra for the respondents 1 & 4. Advocate R Koul who appeared for respondent No 2 & 3 in his reply pleaded that a list of 67 employees was prepared and forwarded to the state Government for grant of approval and the name of petitioner’s husband stands at serial No 58 of the said list. As and when the approval is received from the Government the pensionary claims of these employees including of the petitioner would be processed further and released accordingly. The respondent MD SRTC and Commissioner/Secretary have not filed the objections. Justice Nirmal Singh observed that on the last date of hearing a specific order was passed directing the respondents to file the objections, in case the objections are not filed, the MD SRTC and Commissioner/Secretary Transport were directed to appear in person. On behalf of SRTC, the objections have been filed but the Commissioner/Secretary to Transport Department has not filed the objections, nor appeared. The SRTC has already recommended the case of the petitioner to state Government for approval on June 13, 2006 but no action has been taken, therefore, Commissioner/Secretary Government Transport Department is directed to be summoned through bailable warrants in the sum of Rs 10,000, the Court ordered
