| HC stays SAC proceedings initiated against Astt. Dir. CADP | | | JAMMU, JULY 11- Justice JP Singh of Jammu and Kashmir High Court, Jammu wing, today stayed the proceedings in an appeal filed against the order of Jammu and Kashmir State Accountability Commission (SAC). Justice Singh, after hearing Sr. Adv DC Raina appearing for the petitioner and Adv KS Johal appearing for the private respondent, admitted the petition and issued notice. Court directed Registry shall indicate in the notice that the case shall be taken for final hearing on next date of hearing and the respondents shall be at liberty to file their counter-affidavits or documents in support of their defence to the petition within a period of 30 days from the date of receipt of notice. In the event of filling of counter-affidavit by the respondents, the petitioner shall have one week to file rejoinder to the petition. The proceedings before the SAC shall remain stayed till next date of hearing. In the petition it has been submitted that the petitioner was serving as Assistant Director in CAPD Department and retired on January 31, 2007. That one Raj Kumar Nargotra has filed a complaint against some public functionaries before the SAC in respect of the policy decision of the Government to allot the wheat to the local millers for its grinding in “ATTA” without restoring the tender process. Though initially the complaint was filed on April 12, 2006, however on July 25, 2006 an amended complaint was filed by the complainant before the SAC which although not permissible under relevant provisions of the Act 2002 and the rules made there under, governing the procedure for filling the complaint and its disposal yet was permitted by the SAC and prayed for quashment of proceedings pending before the Commission. Justice JP Singh after hearing both the sides stayed the proceedings pending before the commission till next date of hearing
