Court rejects bail of father, son in murder case

JAMMU, JULY 16- Special Railway Magistrate Jammu Mr. SC Gupta today rejected the bail application of Karim Baksh father-in-law of the deceased and Lal Din husband of the deceased who are involved in abetment to commit suicide.
According to the police report on June 4, 2007 Constable Bal Krishan flashed a wireless message that a dead body was lying in between 85/6.7 meters which was run over by the NDE load plying from Jammu to Pathankote. The dead body was identified as Fia Bibi w/o Lal Din r/o Meen Sarkar Tehsil and District Samba. The police started proceedings in terms of section 174 Cr PC. The statement of one Yaqoob Mohd r/o Meen Sarkar was recorded that Fia Bibi was adopted when she was 10 months old and was married with Lal Din s/o Karim Baksh. After three years of marriage, in-laws of his daughter started harassing her and were separated from the family. She and her husband started residing calmly. A lady was living in a room as tenant in the house of in-laws of his daughter; his son-in-law developed illicit relations with the said lady and due to said relation bickering started between husband and wife. She asked her husband to break the illicit relation with the said lady. On this, he threatened her of doing with her life. He used to beat her. On June 4, 2007 she committed suicide. On the basis of this report case u/s 306 RPC was registered by the GRP Police Station Jammu.
Special Railway Magistrate, after hearing Prosecuting officer Gurjot Kour appearing for the state and Advocate PN Goja appearing for the accused persons, observed that investigation of the case admittedly is yet to be completed. The co-accused Khurshid and Sofia are absconding and yet to be arrested. The IO stated that the statement of lady with whom the accused Lal Din has illicit relation which compelled the deceased to commit suicide is yet to be interrogated. He further stated that she is absconding and her whereabouts are yet not known. Court said that the curtailment of liberty of an individual is required where the larger interest of the society is involved. Faith of the general public is also required to be maintained in the interest of the administration of criminal justice by refusing bail in the present case. It was required on the part of co-accused Khurshid Bibi and Sofia that they would have surrendered before the concerned police or Court. However, they have not done in the present matter. This is a circumstances against the present applicant accused persons also that they would flee from the clutches of law in case they are released on bail at this stage. With these observations, the Court rejected the bail application.
