| DB dismisses acquittal in murder case of two pujaries | | | JAMMU, JULY 17- Division Bench of Jammu and Kashmir High Court Jammu wing comprising Acting Chief Justice Aftab Alam and Justice Nirmal Singh dismissed the criminal acquittal appeal filed the state against the judgment passed by Principal District Judge Poonch on May 3, 2005 whereby the Court below acquitted the accused Mohammed Razwan from the charges of kidnapping and killing two Pujaries. In the dismissal judgment the Division Bench after hearing Additional Advocate General Mr. AH Qazi appearing for the state in this appeal against the judgment of acquittal, observed that “we are satisfied that the judgment of Trial Court is based on a proper appreciation brought before it and there is nothing for this Court to interfere in the matter” and accordingly dismissed the appeal According to the case Police Station Surankote on August 27, 2001 received information that a group of foreign militants along with local ultras entered in Dhundak temple and kidnapped two Pujaries namely Narotam Dass Ji Maharaj and Devi Dass Ji Maharaj and committed their murder, their heads were severed and were kept on the road side of the temple. On receiving this information the police registered a case u/s 302/364 RPC and arrested Mohd Razwan and others. After completion of the investigation, the challan was presented in the Court of law. On May 3, 2005 the then Principal Sessions Judge Poonch Mr. Suresh Sharma after considering all the circumstances of the case and witnesses produced by the prosecution acquitted the accused as prosecution failed to prove its case against the accused. Against this order state filed an appeal which was dismissed by the Division Bench.
