| HC condones 534 days delay on payment of cost Rs 5000 | | |
JAMMU, JULY 17-
Justice YP Nargotra of Jammu and Kashmir High Court Jammu wing today in condoned delay in filling the review petition against the order passed by Justice Permod Kohli the then Judge of the State High court subject to payment of Rs.5000 as cost .
In an interesting case of condonation of delay field by the Chief Engineer and others seeking condonation of 534 days delay caused in filling the review petition against the order dated December 3, 2005 passed by the Justice Permod Kohli in which the Court had directed the respondent to consider the case of husband of the petitioner namely Satpal who was retired at the age of 55 years against the age of 60 years.
Justice YP Nargotra in a review petition seeking condonation of delay issued notice to the respondent Sarla Chopra and others which was accepted by Adv Abhinav Sharma on behalf of non-applicants and submitted that he does not want to oppose the application of condonation of delay. Court after hearing Dy AG Shahista Hakim observed that having regard to the cause shown in the application, Court is satisfied that the delay caused in filling the review petition was not deliberate but was for a sufficient reason. With these observations Court condoned the delay subject to payment of Rs 5000 as cost to be paid to Sarla Chopra respondent within a period of six weeks from today, failing which this application shall be dismissed without further reference to the bench, Court ordered.
It is worthwhile to mention here that Satpal Chopra who was initially appointed as Class-IV and was promoted to the post of meter reader was pre-maturely retired at the age of 55 years instead of 60 years as provided in the government rules. JNF
