| Contracted marriage case’ | | | JAMMU, JULY 21 First Puisne Judge of Jammu and Kashmir High Court Justice Nisar Ahmed Kakru in a petition filed by a daughter seeking restraining her father from causing any interference in the alleged marriage contracted by her with a boy of her choice, dismissed the petition in the back drop that the Court of competent jurisdiction is already seized of the complaint of the daughter against the father. In the petition it has been submitted that the daughter has filed a complaint against her father before the Additional Munsiff Jammu for alleged commission of offence u/s 503/506 RPC. The contention of the counsel for the petitioner’s is that the petitioner No 1 has contracted the marriage out of her own free will with the petitioner No 2. The father of the girl has to desist from causing harassment to her. Justice Kakru, after hearing Adv Rakesh Sharma appearing for the petitioners, observed that in this case daughter has already dragged the father to the litigation and is prosecuting the case against him. More so the Court of competent jurisdiction is already seized of the complaint of the daughter against the father. In the back drop, indulgence is declined and petition is dismissed along with CMP.
