| HC stays promotion of B- Grade Specialist, Unani | | |
JAMMU, JULY 24:- Justice YP Nargotra of Jammu and Kashmir High Court Jammu wing in petition challenging the appointment by promotion of “B” Grade Specialist (Unani) in the Department of Indian System of Medicines, issued notice, accepted by Deputy AG Shahista Hakim on behalf of state respondents and Adv RK Bhatia accepted notice on respondent No 4 who was promoted “B” Grade specialist, directing to file objections within four weeks.
Court, after hearing Adv Abhinav Sharma appearing for the petitioner, ordered that in the meanwhile the implementation of impugned order issued on July 6, 2007 is stayed and the respondents are further restrained from filling up the post of “B” Grade specialist (Unani) in ISM through departmental promotions because of the fact that in terms of SRO 379 of December 12, 2006, the post of “B” Grade specialist (Unani) is to be filled up 100% by direct recruitment.
This Court direction was passed in a petition filed by Dr. Sanjay Kumar Pandita, claiming to be MD Unani, challenging the departmental promotion on the post of “B” Grade specialist (Unani) on the ground that the said post is filled up 100% by direct recruitment through Public Service Commission and promotion if any, made to the said post would be in violation of the recruitment rules.
