| 5 years RI for accused involved in fake currency note case | | | JAMMU, JULY 26- Principal Sessions Judge Jammu Mr. JR Kotwal today awarded five years rigorous imprisonment and fine of Rs 15000 to accused Mohammed Ashraf Rishi s/o Abdul Gani Rishi r/o Hewan Colony, Anantnag, facing trial in a fake currency notes for the last 8 years. According to the prosecution case accused Mohammed Ashraf Rishi used two currency notes of Rs 500 denomination at a shop at Purani Mandi Jammu knowing that the said notes were fake and recovered the same from his possession and a case u/s 489-B and 489-C RPC was registered in the P/S Pacca Danga Jammu and after completion of the investigation challan was presented in the Court of law. While awarding sentence, Principal Sessions Judge observed that offences 489-B and 489-C RPC are serious, first being punishable with imprisonment which may extend to 10 years besides fine and second being punishable with imprisonment which may extend to 7 years or with fine or with both. Offence is heinous as well use and circulation of fake or counterfeit currency is a serious assault on the economy of a country. Supreme Court in a judgment has said that the object of legislature in enacting these provisions is not only to protect the economy of the country but also to provide adequate protection to currency notes. It is in the above background that Court has taken note of the isolated act of the accused. It is not shown that accused is habitually involved in the business of circulating or using the fake or counterfeit currency notes, considering the maximum punishment provided for the said offences and the act of the accused, Court resolve and impose sentence of three years RI with a fine of Rs 10,000 for the offence u/s 489-B RPC and two years RI and fine of Rs 5000 in proof of offence u/s 489-C RPC upon the accused. Imprisonments for both offences shall run concurrently, Court ordered
