| Relief for 'Education Shops' | | HC stays order derecognising franchisee degrees | |
Early Times REPORTER Jammu, July 30: In a fresh round of legal wrangle between the University of Jammu, the State Education department and the distance learning universities the "education shops" shops have emerged dominant as the Jammu and Kashmir High Court has stayed an order of the Jammu University and Directorate of Education doubting the credibility of degrees obtained through Study Centres. It may be mentioned here that for many years now a debate and tussle has been going on about the quality of education and validity of degrees obtained through study centres of the distance education universities or other educational institutions through their franchisee centres. Pursuant to this the University of Jammu and the Directorate of Education had issued order declaring as invalid the degrees obtained from their distance learning universities. However, these orders have remained subject to the legal debate. While the students of these universities and the local franchises says that the Universities are genuine and are recognised by the Government of India or various state governments but the Jammu University and the Directorate of Education are of the opinion that these study centres are quick way to high degrees marring the admission or employment prospects of the students have got education through the J&K's universities after following tough guidelines. In a new development Justice Nirmal Singh of Jammu & Kashmir High Court Jammu wing in a petition challenging the notice issued by College Development Council University of Jammu whereby any courses run by Study Centers/ Franchise of any other university except IGNOU is not recognized by Jammu University challenged, issued notice to state of J&K, Commissioner/Secretary School Education, University of Jammu, IGNOU, Director School Education Jammu and others returnable within four weeks and after hearing Adv DS Chouhan appearing for the petitioner ordered that in the meanwhile operation of impugned notices are stayed, this order, however, subject to objection of other side. It is worthwhile to mention here that CEO Kathua in his letter submitted that the degrees issued by the Universities like NP Bhoj Open University, Annamalal University, Sikkim Manipal University, Punjab Technical University and Lovely Open University Punjab, till clarification is received from Education Council New-Delhi and final disposal of the case the degree will not entertained. This notice and other notices issued by Director Colleges Development Jammu University were challenge by Sunita Kumari of Kathua who had undergone the post-graduate course in the discipline of zoology from the study center of Madhya Pradesh Bhoj Open University Bhopal and on the basis of the post-graduate degree acquired the petitioner is entitled to be considered for her promotion to the post of lecturer in 10+2 Higher Secondary School, which is being denied the right of consideration for promotion to the post of lecturer. Pursuant to the Public Notices dated July 15, 2006 issued by the University of Jammu and seeking quashment of communication issued by Director Education of January 19, 2007 thereby instructing the CEOs of Jammu Province not to entertain the post-graduate degrees issued by the study centers which are not approved by Distance Education Council till clarification is received from Education Council New-Delhi.
