Court acquits four accused as prosecution miserably fails

JAMMU, AUGUST-02:- 2nd Additional Sessions Judge Jammu Mr. AK Koul today acquitted four accused allegedly involved in committing murder of three labourers for petty sum of Rs 7200 as the prosecution miserably failed to connect the accused with the crime.
In the 23 page judgment 2nd Additional Sessions Judge passed strictures against Investigating Officer and observed that there is no dispute about the facts that three persons have been killed, all of them had cut throat injuries. The manner the investigating officer has proceeded to investigate the matter appears to be totally unsatisfactory. A question haunts is as to who was responsible for the triple murder. It is a sad state of affairs that investigating officer has bothered least about the basics of the investigation more particularly when it relates to heinous crime. It is not that the crime could not be detected but it appears that failure of this case is simply on account of defective investigation. Scientific aids could have been helpful in identifying the culprits but the investigating officer has not considered that aspect. He appears to have fulfilled formality because he was answerable to his officers and he laid the charge-sheet unmindful of the fact that the evidence collected by him was deficient in so many respects. Anyway the failure of investigating officer to demonstrate his professional skill has resulted in failure of this case. The evidence on record miserably is short of proving the guilt against the accused. With these observations Court after hearing APP and Adv RK Kotwal and Gurdeep Singh appearing for the accused persons dismissed the challan and acquitted the accused from the charges.
According to the police case on December 3, 2000 a written report was lodged by one Puran Singh with the police station Domana that he is constructing a house at Mohar Barnaie. For watch and ward he engaged five labourers and they are putting up in the same house. One day he went to house and found both the doors locked on looking through the windows he saw the three labourers namely Pramod alias Pandu, Mehar and Ganga lying dead with their throats silt and blood lying on floor. On receipt of this information Domana Police registered a case u/s 302 RPC and started investigation. During the investigations police arrested Prahlad Brar, Ratnakar, Sadashiv Pradhan and Parbhat Brar all are residents of Orissa whereas the deceased also belonged to Orissa. After completion of the investigation challan was presented in the Court. JNF
