Court awards 3 yrs imprisonment to accused facing trial since 1998

JAMMU, AUGUST-04- 2nd Additional Sessions Judge Jammu Mr. AK Koul today awarded three years imprisonment and fine Rs of 5000 to accused Romesh Lal r/o Gigian, RS Pura, facing trial in an attempt to murder case since May 25, 1998, and ordered if fine deposited shall be paid to the injured as compensation.
According to the police case on May 25, 1998 a source report received by the P/S RS Pura that Surinder Kumar has been admitted in RS Pura Hospital in a injured condition. The police recorded the statement of injured who in his statement said that he was back to his home about 8:30 PM, the accused was also going his house restrained him wrongfully and launched a murderous assault on him with a DAH. The victim sustained injuries on the head and back and was admitted to the hospital. A case u/s 307/341/324 RPC was registered and after completion of the investigation presented challan in the Court of law.
The 2nd Additional Sessions Judge, after hearing APP Ravinder Sharma appearing for the state and Adv BR Sharma appearing for the accused, observed that the accused is a young man and must be around 23 years of age and has faced this trial since mid 1998. One can imagine the trauma he must have faced during past nine years. Apart from that one needs to keep in view that deterrence has not paid any dividends. The crime graph is showing a considerable rise and the modern trend is that a delinquent must be treated with sympathy so that he and his family do not suffer much more than they deserve. It is true that injured has suffered on account of the crime committed by the accused but at the same time the element of reformation age of accused, period of trial faced by him cannot be forgotten. So while convicting the accused u/s 307 RPC sentenced him for a term of three years and fine Rs 5000. The accused is also sentenced for commission of offence u/s 341. Fine if deposited shall be paid to the injured as compensation. The accused, present in the Court, was taken into custody and sent to jail to serve the sentence. JNF
