Court acquits three after 21 years of investigation, trial
Nine accused die during investigation

JAMMU, AUGUST-06 -Special Judge Anticorruption Jammu Mr. Kartar Singh in a land restoration case has acquitted three accused after 21 year long investigation and trial while nine other accused had died during the investigation.
According to the Vigilance case the accused persons by impersonating and with the connivance filed an application for restoration of land measuring 173 Kanals and 8 Marlas situated at village Deeli in the year 1973 and thereby received undue compensation in lieu of the said land and got it resorted on their names. After preliminary enquiry the Vigilance Organization registered case u/s 5(2) of PC Act r/w section 420/467/120-B RPC and started investigation and after the completion of the investigation challan was presented in the Court of Special Judge Anticorruption Jammu.
Special Judge Anticorruption, after hearing CPO Mr. Onkar Singh and SPO Suresh Kumar appearing for the state and Adv RS Thakur and Adv Rakesh Pandita appearing for the accused persons, took serious note of the investigating agency and said that this case has a chequered history that FIR was registered against the accused on May 8, 1986 and it took 15 years for investigating agency to investigate the case. During the pendency of the investigation, five accused died and ultimately on December 18, 2000, the challan against the remaining accused was presented before this Court. Vide order dated March 20, 2004, seven accused were discharged and charge was framed against other accused. It was during the pendency of the trial that almighty took the decision on the fate of four more accused and they also left for heavenly abode. At present only accused Imitiaz Ahmed r/o Darsupura Tehsil RS Pura, Mohd Shafi r/o Digaiana Jammu and Noor Hussain also resident of Digaiana Jammu are facing trial in this Court.
In the acquittal judgment Mr. Kartar Singh observed that the statements of the accused were not recorded under the provision of section 342 CrPC and it was observed by the then Presiding Officer that there was no need to record their statements which goes to prove that there is no incriminating evidence against them. The charge against the accused Imitiaz Ahmed is that he personated for Anayat-Ullah before the then Deputy Custodian and prayed for the restoration of land in his favour, whereas, Mohd Shafi and Noor Hussain have also done like this and got their statement recorded. But not a single witness examined by the prosecution has stated anything against them. The prosecution has examined only those witnesses who are witnesses of seizure memos only. These are not even iota criminating evidence against the accused and they are therefore acquitted of the charge framed against them.
