| Dismissal of AEE, JE case | | HC stays operation of SAC’s recommendations | |
JAMMU, AUGUST-06- Justice YP Nargotra of Jammu & Kashmir High Court Jammu wing in a petition filed by DK Razdan AEE and Virender Kumar Sharma JE R&B Sub-Division Batote against whom the State Accountability Commission (SAC) recommended their dismissal from service, has ordered that operation of the report of Commission dated July 25, 2007 shall not be implemented so far as it relates to the dismissal of petitioners from service. Justice YP Nargotra after hearing Sr. Adv UK Jalali with Adv Anil Khajuria appearing for the petitioners and Adv Vinod Kotwal appearing for the complainant respondent No 3 in the petition, issued notice, directing counsel for the petitioner that they shall take necessary steps for service of Commissioner/Secretary PWD and J&K State Accountability Commission through its Registrar within a week’s time, failing which their names shall be deemed to have been deleted from the array of respondents. In the meanwhile, Justice YP Nargotra clarified this order shall not come in the way of the respondents in releasing the amount due to the private respondent’s complainant in terms of report of Commission under challenge. The same shall however be subject to the outcome of the main petition. In the petition the petitioners challenged the recommendation of SAC on various grounds and sought directions to Commissioner/Secretary PWD not to initiate any proceedings in pursuant to the recommendation/ report dated July 25, 2007
