| Wheat grinding case | | DB directs CAPD to allow petitioner to participate in tender process | | JAMMU, AUGUST-07- Division Bench of Jammu and Kashmir High Court Jammu wing comprising Justice Virender Singh and Justice Mansoor Ahmed Mir today stayed the operation of judgment of Single Judge and directed Director Consumer Affairs and Public Distribution Department Jammu to allow the appellants to participate in the fresh tender process in terms of tender notice. This order was passed by the Division Bench in LPA filed by Raj Kumar Nargotra of M/S Mahajan Roller Flour Mills Jammu against the judgment of Single Judge in which the petitioner submitted that in case appellants are not allowed to participate in the tender process which has been set in motion a great pre-judice would be caused to them. DB after hearing Sr. Adv ZA Shah with Adv KS Johal appearing for the appellants, Advocate General AH Naik appearing for the caveators /respondents and Adv Sunil Sethi also for the caveator, discharged caveats and admitted the LPA and issued notice to the respondents and in the meanwhile stayed the operation of the judgment of the Single Judge and also directed Director CAPD to allow the appellants to participate in the fresh tender process in terms of the tender notice. DB also directed Advocate General, who was present in the Court, to communicate the order to the concerned authorities before 1:00 PM today itself possibility may be telephonically or by any other mode
