| Ritu Gupta case | | Dowry death abettor doctor denied bail | | Udhampur, Aug 8: Principal Sessions Judge Udhampur AK Shan today rejected anticipatory bail applications of accused in dowry death case.
The court rejected bail pleas of Dr. Vinay Gupta husband of the deceased, a dental Surgeon, Rakesh Gupta, Pooja Gupta all sons and daughter of Lt. Sansar Chand Gupta and Kunti Devi widow of Sansar Chand Gupta.
According to the police report deceased Ritu Gupta was married in the year 1999 with Dr. Vinay Gupta who is a dental surgeon and deceased was also dental surgeon but was unemployed. Immediately after the marriage husband of the deceased his brother, sister and mother who were also the applicants started demanding more dowry although at the time of marriage the demand for dowry has been met satisfactory by the father of deceased.
The deceased fed up with cruel behaviour of her-in-laws and ultimately she jumped into the river Ganga at Rishikesh on July 3, 2007 and ended her life. On July 7, 2007 the father of the deceased lodged a written report with P/S Udhampur, the police registered case u/s 498-A/306 RPC. As per the FIR immediately after the marriage accused persons started demanding dowry. The demand was met by the father of the deceased as he wanted that his daughter to remain happy without any tension or torture from her in-laws. But all in vein accused persons started man-handling the deceased. She informed her father who asked her to have courage. Her father told the deceased that after the marriage of accused Pooja Gupta who is the sister of her husband Dr. Vinay Gupta that every thing will be settle. But even after marriage of Pooja Gupta in the month of April, 2007, the situation did not improved. Although, some demands projected by the accused at the time of marriage of Pooja Gupta also met by the father of the deceased but it also no impact on the attitude of the behavior of accused persons.
Principal Sessions Judge AK Shan after hearing Advocates KB Gupta and Dinkar Gupta appearing for the applicants and Adv SC Gupta along with Public Prosecutor appearing for the state observed that for false involvement of accused Pooja Gupta, her counsel laid great stress but to the contrary reply by the public prosecutor that said accused as per CD file as played a major role not only before her marriage but even after her marriage, when she came to Udhampur and joined other accused persons in assaulting and humiliating the deceased to such an extent which provoked the deceased who was young talented lady to commit suicide. PP further stated that in normal conditions no lady will take to finish her life unless she is faced by surcharged atmosphere created by the misbehaviors and unbecoming attitude of her husband and in-laws. Upon this Principal Sessions Judge Udhampur. AK Shan referred a judgment of the Supreme Court and observed that Court find the applicants have not made out an exceptional case for admitting them to anticipatory bail. Keeping in view the serious accusation and larger interest of the society, where the misbehavior of the in-laws is forcing the wedded wives to commit the suicide, Court also do not find any justification to admit the applications of anticipatory bail. With these observations Court dismissed the bail applications of the accused persons.
