PMO holds J&K, Gujarat judge's appointment to SC

Jammu, Aug 12: Perhaps for the first time in the judicial history of the country, the Prime Minister's Office has returned a proposal for the appointment of High Court Judges to the Supreme Court.

It is reliably learnt that the Prime Minister has send the file to the Law Ministry with note to forward the same to the Supreme Court. One of the Judges whom the Prime Minister did not approve for appointment to the Supreme Court belongs to the Jammu and Kashmir High Court while the other Judge is from the Gujarat High Court.

The Prime Minister's Office (PMO) for the first time has reacted in such a manner to the judiciary. It may be recalled here that earlier this year also the Prime Minister made remarks on the judiciary saying that this important pillar of the democracy should not overstretch its arms.

Sources disclosed that the PMO has returned two files related to appointments of top judges to the Law Ministry for reconsideration to the Supreme Court. The two High Court judges are from Gujarat and Jammu and Kashmir. Their appointments had been cleared off by the Supreme Court itself.

Reacting for the first time to the contends about the judiciary, the PMO is reported to have said, "This action has been taken because the PMO is anxious that competent and qualified judges should man the judiciary."

The Prime Minister's reservations come days after the Supreme Court itself had asked the Centre as to how many judges had been appointed after consulting the Supreme Court collegium.

A top source, quoting some Law ministry officials said that there could be at least 10 judges who could have been appointed in the last one year despite adverse IB reports. It's this data that is likely to be a part of an affidavit prepared by the Centre.
