| Case decided after 15 years trial | | Court awards 5 yr. imprisonment to sister-in-law of the deceased | | JAMMU, AUGUST-1- Additional Sessions Judge Jammu Mr. Rakesh Sagar Jain awarded five years imprisonment to accused Manjeet Kour sister-in-law of the deceased and fine of Rs 5000 u/s 304-II RPC in a case of dowry demand after 15 years trial. According to the prosecution case on January 15, 1992, the police post Rakh-Amb Samba on information that deceased Nita Devi wife of Bhajan Singh admitted in Medical Hospital. Incharge Police Post recorded the statement of Nita in the hospital. In the said statement, 18 year Nita Devi stated that she was married to Bhajan seven months before her mother-in-law Giano Devi, Sister-in-Law Manjeet Kour, brother-in-law Mohan Lal, Harnam Singh and her husband Bhajan Singh frequently without any reason troubled and also quarreled with her. Since last 7/8 days they are saying that she has hidden the jewellary and she has been telling them that she is not at fault. On January 13, 1992 at about 7:00 PM her sister-in-law Manjeet Kour holding a burning kerosene oil lamp entered in the room with an intention to kill her threw the burning lamp on her, which fell on her legs and her ‘Shilwar’ caught fire. She raised hue and cry and tried to put out the fire and her both legs from feet up to high and right hand got burned. Thereafter woman and one male from the neighborhood came on spot whereupon her mother-in-law and sister-in-law took her outside to the tap and doused the fire with water. Thereafter the neighborer and her brother-in-law took her on a tractor to hospital Samba from where she was sent to Jammu hospital. Her sister-in-law burnt her with an intention to kill her in pursuance of a conspiracy with other persons. After recording the statements a case u/s 302 RPC was registered and accused Manjeet Kour was arrested and later on was released on bail by the Court. Additional Sessions Judge Jammu Mr. Rakesh Sagar Jain, after hearing Additional Public Prosecutor Mr. Vijay Kumar Sharma appearing for the state and Advocate K Sharma appearing for the accused, observed that taking into consideration the facts that the deceased got discharged from the hospital and applied local ointment whereby her condition worsened and it being possible that she would have survived had she got professional medical treatment. Apparently the deceased died for want of proper medical aid and attention, one month and 20 days after the occurrence. Hence accused Manjeet Kour is convicted for offence u/s 304-II RPC. Court on August 16, 2007 cancelled the bail bond of the accused took her into custody and on the question of the quantum of sentence Court after hearing both the sides awarded five years imprisonment and fine of Rs 5000 u/s 304-II RPC.
