| HC stays implementation select list of MOs Homoeopathic | | | JAMMU, AUGUST-17- Justice Virender Singh of Jammu & Kashmir High Court Jammu wing today stayed the operation of list of Medical Officers of Homoeopathic till further orders. This Court direction has been passed in petition filed by Dr. Navkiran Kapoor through Adv Surinder Kour challenging the selection of 15 Medical Officers Homeopathy in Health and Medical Education Department on the allegation of favoritism as one of the selected Dr. Showkat Ahmed Lone is not registered with the J&K Homo Board and has not applied for registration so far. It is clear from the record that Showkat Ahmed Lone is not qualified because as per the rules prescribed for the post of Medical Officer Homeopathy whereas the petitioner is a degree holder and undergone degree of bachelor of homoeopathic medicines and surgery from Baba Farid University of Health and Sciences. Justice Singh after hearing the counsel for the petitioner observed that the petitioner prays for interim direction to official respondents not to issue appointment orders in favour of 15 private respondents by virtue of select list dated June 13, 2007 as it is bad in the eyes of law being based on favoritism, according to Adv Surinder Kour that the petitioner has become victim of the same. On the main malafide projected by the advocate for the petitioner is that the official respondents have selected Dr. Showkat Ahmed lone who was not even registered with the J&K Homoeopathy board and has not even applied for registration, therefore, he was not eligible for the post and ignored the petitioner who was also not only eligible and entitled but was meritorious. The counsel has pointed out other mala- fides as well as seeking for the interim relief. Prima-facie Court finds substance in the submission advanced by Adv Surinder Kour appearing for the petitioner and ordered that select list be not implemented till further orders.
