| Total ban on polythene bags suicidal; PMTA | | | Jammu- August 17: J&K Polythene Manufactures and Traders Association (PMTA) have expressed serious concern over the reported move by the state government to bring a bill in the forthcoming session of the J&K Legislature, commencing from August 20 providing for total ban on manufacture, trading and use of polythene bags in the whole of state. Polythene Manufactures and Traders Association has drawn the attention of the government as well as the legislators that a Special Leave Petition (SLP), titled J&K Polythene Manufactures and Traders Association Vs S R Institute of Development and others through senior advocate Arun Jaitly along with Gaurav Pachnanda, Vikas Mehta and Pranav Kohli already stands admitted in the Supreme Court of India. Vide the order of the Apex court dated 12-02-2007 notices have already been issued to the state of J&K, Divisional Commissioners Kashmir and Jammu Directors Food and Supply Kashmir and Jammu Divisions and Commissioners Municipal Corporation Srinagar and Jammu in response to the Special Leave filed by the Association. This Special Leave was filed by the Association in the background of the High Court of the J&K directing the state government to submit the status report with regard to the problem created by the polythene carry bags and action sought to be taken by the government in this behalf. Since the matter is pending and the Supreme Court of India is seized of the validity of the order passed by the Division bench of the High Court, any decision taken by the government including adoption of any bill to impose total ban on the manufacture, trade and use of polythene bags will tantamount to interfering in the proceedings of the Supreme Court and will be challenged by the Association of Polythene Manufactures and traders. The partial ban already imposed by the Division Bench of the High Court on manufacture of polythene bags below 20 microns as well as use and carrying of all types of poly bags in certain tourists places and hospitals etc, which was fully approved and supported by the association, has not been properly implemented by the concerned authorities. Now to cover their own failure to implement the order of the High Court, the government is learnt to be contemplating to impose blanket ban on the polythene bags through legislation in the coming session of the legislature. This move is totally unjustified, dangerous and wrought with serious consequences. Besides rendering about 2 lakh people jobless, snatching the livelihood of manufacturers and wholesale and retail dealers in polythene carry bags .It will create a great problem for the consumers in general and a sort of chaos will be created, since at present everything from A to Z is being packed, sold and carried in polythene bags. There is no alternative to the polythene bags, which are the cheapest and most convenient means of packaging and carrying
