| Court issues directions to Govt. to consider petitioners for promotion as AEEs | | |
JAMMU AUGUST-20- Justice YP Nargotra of Jammu and Kashmir High Court Jammu wing in a petition filed by Daulat Ram and 10 others directed state of J&K through Principal Secretary PDD and Commissioner PDD that they shall accord consideration to the case of the petitioners in terms of the order dated March 28, 2007 passed by the High Court before making further promotions to the post of Assistant Executive Engineers.
High Court in a petition claiming promotions from retrospective dates disposed off petition vide order dated March 28, 2007 with the direction to respondents to consider the petitioners along with other eligible candidates for promotion to the post of Assistant Engineer (electric) in the PDD with effect from the dates they become entitled to such consideration under the Service and Reservations Rules of 1994, governing their promotion.
While disposing of the petition in terms of the above directions, this Court observed that responding to the contention of Advocate Sunil Sethi appearing for the petitioners, Deputy Advocate General S Hakim submitted that the official respondents would have no objection in considering the petitioner's case too along with all other eligible candidates while making substantive promotions against the posts of Assistant Engineers and the petitioner would be considered for promotion with effect from date they become entitled to such consideration in terms of SRO 126 of 1994.
Advocate Sunil Sethi appearing for the petitioners submitted that during the pendency of said petition, the petitioners stood already promoted to the post of Assistant Engineers vide order December 29, 2006. However, the only question which remained to be considered was as to from which date they were to be given the benefit of promotion. He further submitted that despite direction dated March 28, 2007, the respondents have not passed any order for deciding as to from which date the petitioners are to be given the benefit of promotion. His case is that further promotions to the post of AEE are going to be finalized and in case the petitioners are given the retrospective benefits from the date they claim, they would become eligible for consideration for promotion to the post of AEE.
Justice YP Nargotra after hearing both sides issued notice to respondents and in the meanwhile directed the respondents to accord consideration to the case of the petitioners in terms of order dated March 28, 2007 before making further promotions to the post of AEE. JNF
